John Inouye Prof. Jagiella Bus 206 - T6572 Business Law 9 August 2023 Tort Law Tort law is an area of law that covers civil suits, in where the tort or the harming of others must be compensated for. Those that are victims of wrongful acts caused by others are provided relief usually through monetary compensation. In business, tort law will generally affect how your company may conduct business. This is because tort law holds your business liable for any wrongful acts that are committed by individuals who act on behalf of the business, sometimes unknowing. A business should know how to defend the company and stockholders against a possible financial loss that are from the wrongful acts of a person inside the company. In the case with The Friendly Dawg and Sunshine Yoga, the additional noise from live animals and escaping snakes that were not supposed to be in the store would fall under tort law. The tort that is seen in this case is negligence by both The Friendly Dawg and the landlord of the complex. In this case with Sunshine Yoga, the duty would the lack of peace from animal noises and safety of her clients when the snake escaped into her part of the building. Both Lou and Dave have breached their duty of care by not ensuring the animals were secured and not disturbing the peace. Jasmine complained multiple times to Lou about the noise and how she was losing clients because of the noise. Lou failed to act and take any steps to remedy the issue. With the introduction of live animals Dave took on a responsibility to not only keep the animals
safe but keep any person safe from the animals. When the escaped snake made its way into the yoga studio this breached the safety of anyone inside the yoga studio. Jasmine would be able to seek compensatory damages from Lou and Dave for these incidents since she lost clients which directly affects her ability to make an income. In addition, she could go after both for punitive damages, Lou should be responsible for the snake's ability to breach the air duct system to get from one tenants' space to another. The punitive damages on the part of Dave would be for the trauma that was suffered by Jasmine after the unexpected encounter with the snake in her yoga studio. I would consider the snake escaping into the yoga studio an example of gross negligence.
