Project Three: Tort Law Business Law I Southern New Hampshire University Elijah Cutshall Tort Law: What is Tort Law? A tort is a civil wrong that gives the injured party the right to bring a lawsuit against the wrongdoer to recover compensation for injuries. (Kubasek, 2020, p.90) Not every state has the same definition of torts. Some claims may provide penalties to businesses to stop them from future wrong doings or provide compensation for damages or loss of business. There are three types of torts First one is Intentional tort which occurs when a defendant takes action to intend certain consequences or knowing the results. Second is Negligent tort which occurs when the defendant acts in a way that the subject or other people are at unreasonable risk of harm. The final tort is Strict-liability tort when the defendant takes action that is dangerous and cannot be safe, no matter the precautions the defendant taken. (Kubasek, 2020, p. 91) Relevant Tort Law: The relevant tort law between The Friendly Dawg and Sunshine Yoga would be Negligent Tort Law. Dave the owner of The Friendly Dawg did not take proper measures to ensure that all his animals were kept in a safe environment. Dave's neglection on proper storage of his animals led to a dangerous snake escaping and entering the air ducts which climbed over to Jasmine's yoga studio which caused her to have a heart attack and possibly put others in danger. Legal Claims: Sunshine Yoga owner Jasmine could potentially file a claim against both the Dave the owner of The Friendly Dawg and the landlord Lou for neglect. Dave neglected his responsibility
in taking care and creating a safe environment for all of his animals. Not taking proper precautions on how to properly store and hold animals caused a dangerous snake to crawl through the vents and give Jasmine a heart attack. Lou is also negligent for theoretically knowing that Dave was holding dangerous animals and not letting other tenants know about it. It could be assumed that Lou truly didn't know what animals were being held at The Friendly Dawg, but again that would still be neglect on not knowing what was happening in his building. Jasmine could seek compensation for her medical bills plus lost business and income since the loud noises was disturbing and being ignored along with a dangerous snake roaming free.
