Running Head: BUSINESS LAW I PROJECT 3 1 BUSINESS LAW I PROJECT 3 TORT LAW Jonathan Foster-Harmon Business Department, Southern New Hampshire University Business 206 T3159 Business Law I 22EW3 Professor Laycie Ewing February 18 2022 BUSINESS LAW I PROJECT 3 Cornell Law School defines tort laws as "Tort law is an act or omission that gives rise to injury or harm to another and amounts to a civil wrong for which courts impose liability. In simple Tort laws are laws put in place to control any situations where injury is caused due to invasion of legal rights. Harm in this situation describes a loss or detriment in fact that an individual suffers." In smaller words tort law is there to protect those who become injured or suffer from some other circumstances that would be out of their control while living their normal life. Torts can affect everyday business due to how small situations can arise and become large ones. For example, an employee not placing a wet floor sign in an area that was freshly mopped or wet from a leak could lead to a customer or another employee falling and hurting them selves very badly. A situation like that could lead that individual to sue and call upon these Tort laws to help their case against that company. In this scenario the tort law that can be called into play would be Liability for Wild Animals. When The Friendly Dawg had a snake escape its enclosure and make its way into the Sunshine Yoga studio where it caused Jasmine to suffer a heart attack, this technically gives Jasmine the right to call upon this tort law to get compensation for the suffering and ailments she is now suffering from due to the snake getting into her studio. In this situation legally Jasmine has the right to claim liability for all her injuries and sufferings that she delt with due to this encounter. The friendly dawg is responsible for taking care of all her medical expenses and counseling that has arisen from this situation. Another tort that will come up is that it was a dangerous snake making it an abnormally dangerous wildlife specimen. Due to this added factor the Friendly Dawg will have very strict liability that will be enforced upon them In conclusion the current situation would indeed be applicable to Jasmine in court under the Tort law of Liability for dangerous animals as well as Strict Liability for abnormally BUSINESS LAW I PROJECT 3 dangerous animals due to the snake being extremely dangerous. Due to the Friendly Dawg possessing and storing the very dangerous snake they are fully responsible for ensuring the proper housing and security measures for making sure the snake is properly encaged and can not escape. But due to that snake getting out and being able to get into another tenant's space and causing both injury and harm to the tenant. The Friendly Dawg will be liable and strictly liable for all expense
