Tort Law
What is tort law, Tort law is a civil law that allows the injured party to bring a lawsuit against
the wrongdoer for compensation. There are three different objectives to tort law. One is to
provide compensation for injured parties, the second objective is to discourage the injured party
from retaliating, and the third objective is to show that if you do something wrong towards
another person, the wrongdoer will have to pay for their crime.
There are three different types of Tort Law. The first is intentional tort, where the defendant
engages in a specific act that results in an injury. The second is negligent act, it is where a person
acts unreasonably and subjects others to unreasonable harm. The last is strict-liability tort, it is
when a defendant takes an action that cannot be undertaken safely
Torts toward a business a different than torts against a person. Torts against a business results
in injury to economic interests. In the scenario discussed, Jasmine with Sunshine Yoga has
relevant torts law regarding the loss of compensation she has endured. Regarding her neighbor
business, The Friendly Dawg, a pet store now having live animals for sale, there is an increase in
noise from barking animals. There was also a snake that got loose from inside the pet store, and
got into the airducts and fell from one that is inside Sunshine Yoga. Due to these issues, Jasmine
and Sunshine Yoga have had loss of clients resulting in a loss of income, Jasmine also suffered a
heart attack from the snake.
Jasmine as a few legal claims against Landlord Lou and The Friendly Dawg. One claim is a
breach of contract with Landlord Lou, even though it is a verbal contract, Jasmine and Sunshine
Yoga are not being allowed a quite enjoyable space due to The Friendly Dawg and the noise
coming from the store. She has informed the landlord multiple times of the noise and nothing has
been done. She is now losing clients, and therefore losing money. She has a claim of nuisance
towards The Friendly Dawg. A nuisance is "When a person uses his or her property, in an
unreasonable manner that harms a neighbors use or enjoyment of property." (Kubasek, 2020, pg
211) This results from the excessive noise coming from The Friendly Dawg
Jasmine and Sunshine Yoga have a legal responsibility to pay rent on time, and not to
withhold rent all together. If something has happened, and it is not a criminal law, she can take
her case to a civil court to obtain compensation for her issues. Landlord Lou also has a legal
responsibility to provide a safe, enjoyable space to his tenants. Even if said tenant come to him
with small issues, she is allowed to do so. If needed, Landlord Lou needs to renegotiate terms
with both tenants to maintain a safe, enjoyable environment for all parties.
