On pages 105-110 of the Worrall text there is a section regarding "Expansion of Stop and Frisk". After reading that section of the text, Consider the following set of circumstances- Officers approach a known "Crack house" and see two young men on the porch. As officers get closer, the two young men leave the porch and begin to walk away from the house. Officers stop the two young men and frisk them. Each officer performs the frisk of one of the men who was on the porch. One officer pats the jacket pocket of the man he is frisking and feels something long and tubular. He reaches into the pocket and pulls out a cigar holder. The officer opens the holder and finds a plastic baggie with a white powdery substance inside. The baggie is seized, and that man is arrested for drug possession. The second officer frisks the other young man, and while patting down the outside of the man's jacket, he feels what he immediately recognizes as a small semi-automatic pistol. The second young man is arrested on charges of carrying a concealed weapon. Which charges will stand, and why?
