A Counselor is treating a client who is involved in a legal proceeding. The client presents the Counselor with information about a well-known, local Counselor who released confidential information to an attorney without a signed release or court order. After the Counselor reviews the information presented, it is clear to the treating Counselor that other Counselor breached confidentiality.
The treating Counselor knows the local Counselor who released the information, but does not have a strong relationship with him. The treating Counselor is questioning what to do. The treating Counselor believes the options are:
Address the matter with the other Counselor directly.
Refer the matter to the State Licensing Board for Counselors.
Encourage the client to file a complaint with the State Board for Counselors.
