Mr. John Sangwa is a businessman based in Nakonde. He deals in buying and selling cars; his suppliers are a company called ONE DEAL CAR SELLERS based in Kyoto, Japan. In April 2021, he ordered a HUMMER 2000 Model for $30,000.00, inclusive of all incidental costs. The car is black in color and was supposed to be delivered within one month. He transferred the money to the seller immediately after the negotiations were done and he was satisfied with the color, model, and the condition of the car, with a maximum distance covered of 20 kilometers and a manufacturing year of 2000, as part of the terms of the agreement.
The car was loaded onto the ship on April 1, 2021, and was supposed to arrive at Dares-salaam Port on May 1, 2021. However, a week after dispatch, he was informed that the ship carrying the car was hit by a tornado, causing extensive damage to the car. The car was then put on another ship and finally landed at the port in Tanzania on June 1, 2021. Upon inspection, he discovered that the windshield was shattered and the left fender and two view mirrors were badly dented. Tornado damage was not covered by the insurance, as it was considered a natural calamity that was unforeseeable. When he contacted the sellers, he was informed that they were not responsible for the tornado.
Mr. John Sangwa is your uncle and guardian. He doesn't know what to do. Kindly give him tenable legal advice, as repairing a Hummer with this damage will cost him a fortune.
