Malingering ā€œis defined as a deliberate attempt to lie or deceive in connection with an illness or disability, exaggerating the symptomatology, with the aim of obtaining a personal benefitā€ (Lopez-Miguel & Pujol-Robinat, 2020, p. 175). Malingering has become an increased concern among individuals with traumatic brain injuries ā€œas studies alert to the tendency to overreport symptoms of traumatic brain injuries for attaining different kinds of compensationā€ (Azeredo et al., 2024, p. 61). Similar behaviors are not atypical in the criminal justice system as individuals risk consequences related to the crime they committed or violating the conditions of their parole/probation. According to Drob et al. (2009), ā€œLimited or inconsistent memory recall, irritability and lack of cooperation, poor test performance and concentration, and delayed symptom onset are frequently considered red flags for malingeringā€ (p. 102). Some implications associated with malingering in the clinical and forensic setting are that their course of treatment or court recommendations may not be accurate, productive, or beneficial. This is because forensic psychologists can only use the information provided to them to develop a treatment plan or make a recommendation to the court during criminal proceedings. According to Boberg et al. (2023), individuals ā€œwith established personality and substance use disorder are at a higher risk of being suspected of malingering, which potentially affects the course of treatmentā€ (p. 234). If professionals conducting evaluations are not intentional about ensuring they are not more suspicious of individuals with personality and substance use disorders, the professional could cause harm to the individual they are treating by providing inaccurate evaluation results and create an ethical problem for themselves as professionals. How might you use the information presented by your colleague to guide and inform your professional decision-making within a forensic psychology context? What is an unanswered question that you have related to your colleagues’ post?
