Bob is a resident of the Navajo Nation who is pulled over in Crownpoint for running a red light. During the stop, Officer Begay notices a small baggie of what, in her opinion, appears to be a crystalline substance in plain view on the passenger seat. From Officer Begay's experience, she believes that the item in the bag may be methamphetamine. Officer Begay asks Bob about the baggie; Bob does not admit to it being methamphetamine, but does say that he has marijuana in the car. Officer Begay issues a citation for running the red light, and allows Bob to drive home.
Officer Begay, the very next day, applies for a search warrant of Bob's vehicle, citing to the baggie that she observed on the passenger seat. She is granted a search warrant. During a search of the vehicle, officers discover marijuana, but not methamphetamine.
Bob is summonsed to Court and charged with possession of a controlled substance (marijuana).
