After careful study of the validity and reliability of drug testing techniques, the Commissioner of the U.S. Customs Service announced a new drug-testing program utilizing urine sampling (UA). Any applicant for, or incumbent of, specific positions that meet one or more of the following criteria would be required to submit to UA testing: (1) the position involves drug interdiction or enforcement; (2) the employee is required to carry a firearm; or (3) the employee handles 'classified' material. Customs employees who test positive for drugs and can provide no satisfactory explanation are subject to dismissal. The union, on behalf of Ms. Jones, agrees that there is a legitimate government interest in a drug-free workplace but argues that this drug-testing program was overly intrusive and violated the employees' right to privacy. Furthermore, they point out that this program lacked either stipulation of probable cause or reasonable suspicion. 1. Does requiring a urine sample constitute a search? 2. Are such searches warranted in the case of U.S. Customs agents? 3. Should the employees in all three categories listed be subject to the drug-testing program?
