The seller has a beautiful dining room ceiling fixture that matches his entire dining room set. If the sales contract does NOT specifically state whether the fixture is included in the sale or excluded from it, the buyer's agent can tell the buyer to expect that the dining room fixture will be: A. excluded from the sale because it is clearly part of the seller's dining room suite of furnishings. B. excluded from the sale if the seller takes it down himself and mends the hole in the ceiling. C. included in the sale only if the buyer purchases the dining room furniture. D. included in the sale because it is attached to the ceiling.

The buyer and seller were very upset with each other at the time of closing over a martin birdhouse. The birdhouse, which was tall and had 20 birdhouses, had been cemented into the ground in front of the garage. Neither of them mentioned the birdhouse to the sales associates prior to closing, and both sales associates believed the birdhouse would stay. When the buyer went by to pick up the keys after closing, the birdhouse was being loaded on the moving truck. The seller claimed this was an example of personal property and the buyer claimed the birdhouse was a fixture. Which statement about the birdhouse is true? The method of annexation in this case was cement. Clearly, the item was affixed and permanent. The birdhouse had to be listed by the buyer on the contract. Since it was not, it is personal property. The birdhouse was purchased by the seller; it should always be his. Even though the birdhouse was cemented into the ground, it is definitely personal property.

A) The brokers need to encourage the parties to seek legal counsel. B) The buyer can terminate the contract. C) The fixes do not become part of the sales agreement. D) The seller can terminate the contract.
